1. Introduction

Web Usability is an independent research and consulting business and uses testers to test clients’ web sites and other digital assets in testing sessions.

Web Usability agrees to use you as a web site Tester at a Testing Session on the following Terms and Conditions. If you have agreed to participate in testing not at a research studio location (e.g. remote testing or at your home) then 4 below does not apply.

2. Appointment

In order to confirm your appointment as a Tester:

  • You must complete and submit the Tester Application Form on our website in accordance with clause 3 below
  • You must accept these terms and conditions
  • Your details, as set out in the Tester Application form, must be accepted by our Client

3. Tester application form

You must complete and submit the Tester Application Form as soon as possible and in any event before the date of the Testing Session.

All information provided by you in your Tester Application Form must be correct, complete and accurate.

You agree that Web Usability may pass the information provided by you in your Tester Application Form (except your personal identifying information) to our Client and that our Client may use such information for market research.

4. Arriving for testing session

Your confirmation e-mail sets out the date, time, location and duration of your Testing Session. If the testing session is at a research location you must ensure that you arrive at least 10 minute before the start of your Testing Session.

If you are unable to attend the Testing Session you must inform us as soon as possible. Web Usability reserves the right not to pay you under clause 6 if you attend after the start time of your Testing Session.

Web Usability will use its reasonable endeavours to ensure that the Testing Session starts on time. If the Testing Session starts later than that given in your e-mail confirmation Web Usability shall not be liable for any losses, costs or expenses suffered by you as a result of the delay.

5. Testing session

You agree that during the Testing Session you may be observed and monitored by Web Usability and their staff and associates and by the Client and the Client’s staff and associates.

You agree that the Testing Sessions may be video and audio recorded and photographed and that these recordings and photographs may be made available to the Client and the Client’s staff and associates for subsequent viewing and/or listening.

6. Payment

In consideration for you travelling to (for in person research), attending and taking part in the Testing Session Web Usability will pay you by PayPal within 3 working days the fee as agreed in your confirmation e-mail. Details will be taken  during the session in order to make this payment as promptly as possible.  You will only be paid the fee on completing the Testing Session.

If you are a business registered for VAT, Web Usability will pay you on production of a VAT invoice the fee plus VAT. Otherwise Web Usability will pay you the fee.

You will be responsible for ensuring that you pay any tax that may be payable on the fee.

7. Cancellation

Web Usability may cancel the Testing Session at any time, up to 24 hours, before the Testing Session is due to start and will not be liable for any losses, costs or expenses suffered by you as a result of the cancellation.

If Web Usability cancels a session less than 24 hours before the Testing session is due to start Web Usability will pay you the fee agreed in your confirmation e-mail, but will not be liable for any other losses, costs or expenses suffered by you as a result of the cancellation.

8. Confidentiality

If you are advised, in your confirmation e-mail, that the web site you will observe in the Testing Session contains confidential information you may not communicate this information to any other person or use it for your own purposes at any time.

9. Intellectual property rights

The rights in the web site that you will observe in the Testing Session belong to the Client. You may not copy the web site or any material taken from it.

10. Your personal information

We use your personal identifying information solely for the purpose of identifying projects for which you are suitable, approaching you about these and managing research sessions. You agree that Web Usability can use your personal data for these purposes.

Web Usability will not release your name or address or other personal identifying information to anyone and will not sell, distribute, publish or otherwise disclose your personal identifying information without your express permission.

11. Governing law and jurisdiction

The construction, validity and performance of this Agreement shall be governed in all respects by English law.
